Definitions

“We,” “Us,” “Our,” and “Foldabl Homes” refer to Foldabl Homes Pty Ltd, inclusive of all authorized representatives and dealers.
“Products,” “Goods,” or “Units” cover the range of Foldabl Homes offerings, spanning from manufactured homes to caravans and all related equipment.
“You” and “Your” denote our esteemed clients or purchasers, along with any authorized dealers.

Terms Modification

We reserve the right to modify these Terms at our discretion, ensuring you’re notified of significant updates whenever feasible.

Consumer Guarantees

Our products are backed by guarantees as per the Australian Consumer Law. This includes entitlements to refunds or replacements for major failures, alongside repair or replacement for lesser quality issues. However, we are not liable for consequential damages and expect you to indemnify us against such claims. If there’s a fault with your goods, stop using them and contact us immediately. Any repairs or replacements made without notifying us may not be reimbursed.

Warranty Limitations

Under this warranty, we are not liable for indirect losses or damages. Repairs or replacements are your sole recourse, with our total liability not exceeding the product’s purchase price.

Product Faults

In the event of a product fault, cease usage and contact us directly. We reserve the right to rectify faults using local tradespeople or our technicians. Unauthorized repairs before notification may void reimbursement eligibility.

Warranty Details

– All parts are guaranteed against defects for 12 months.
– We may opt for local tradespeople or our technicians for repairs, which are provided at no cost to you.
– Return shipping costs are your responsibility, with the right to refuse or replace parts as needed.
– Warranty avoidance conditions include unauthorized alterations or neglect in maintenance.

Product Setup

Responsibilities include ensuring proper electrical, plumbing, and structural setup by licensed professionals. Compliance with council regulations and safety laws, including smoke alarm installation, is mandatory. We bear no responsibility for any damages or injuries resulting from third-party actions during setup, and you must regularly check the product’s foundations for stability.

General Terms

– It’s crucial to verify local regulations and suitability of our products for your intended use.
– We are not liable for council penalties due to product misuse.
– Our products, manufactured overseas, are quality checked but minor imperfections due to transport may exist.

Refunds and Cancellations

Refund eligibility is assessed on a case-by-case basis and subject to conditions.
Deposit cancellation terms vary with the product type, with specified fees applicable. and overdue payments will accrue interest.

Payments and Delivery

Full payment is required prior to delivery or collection.
Delivery subcontracting rights are reserved and adjust delivery fees accordingly, with the provision of access for delivery being your responsibility. Force majeure events may affect delivery times.

Payment Process:

1. Deposit Paid: When you pay the deposit, your order is considered accepted, and we allocate stock accordingly.

2. Balance Due: Two weeks before your completion date, we will send you an invoice for the final payment.

3. Foldabl can arrange delivery for an additional fee, or you can organize delivery yourself.

4. Delivery: Once payment is received, we will schedule your delivery for the next available date or have your cabin ready for collection.

Delivery:

1. You authorize us to subcontract, assign, or transfer delivery of your Products at any time without prior notice. Sub-contractors have the same rights as us under these Terms of Sale.

2. You must ensure complete and uninterrupted access to your property to facilitate the delivery of your Products.

3. Our drivers will make every effort to deliver your Products to your desired location on your property, considering site conditions such as surface, slope, and weather. The driver will choose the unloading area.

4. You guarantee that the ground surfaces traversed by our drivers during delivery are suitable to prevent damage to the surfaces or our drivers’ trucks.

5. Delivery times are estimates starting from the date of deposit payment.

6. Estimated arrival dates are not guaranteed and may change due to unforeseen circumstances or Force Majeure events. We’ll make reasonable efforts to fulfill your order in a timely manner, but delays do not entitle you to cancel your order or claim consequential damages.

7. We reserve the right to adjust delivery prices to reflect increased costs imposed by our drivers or other factors. You’ll be notified in writing of any fee adjustments.

8. You have the option to arrange your own transport for picking up your Products.

9. If our drivers can’t unload at the designated area on your property, they may leave your Products on the nearest Council road in a safe position.

10. You indemnify us against any loss, damage, liabilities, or claims caused directly or indirectly by our drivers.

Force Majeure

In events beyond our control, we are exempt from obligations until such circumstances cease, with the option to terminate or maintain orders. Include but are not limited to illness, unavailability of materials, health crises, strikes, natural disasters, government decrees, transport difficulties, and computer malfunctions.

Default and Indemnity

On default, we reserve rights including withholding product delivery or retain payments.. You agree to indemnify us against any claims arising from product use or terms breach.

Intellectual Property

All intellectual property rights related to our products remain with Foldabl Homes Pty Ltd, with obligations to respect and not infringe upon these rights.

Governing Law and Severability

These terms are governed by the laws of Victoria, Australia, with any unenforceable provisions not affecting the remainder.

Acknowledgment

If any provision of these terms is found to be unenforceable, it will not affect the validity of the remaining provisions. Your deposit signifies acceptance of these terms, which represent our mutual agreement as of the last update.
